1. Agreement to Terms

By accessing and using RealtyProfit ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to abide by the above, please do not use this service.

2. Service Description

RealtyProfit is a profit management platform designed for real estate brokers and agents to track transactions, expenses, and profitability. The platform provides tools for financial tracking, team management, budget analysis, and AI-powered insights.

3. Use License

Permission is granted to use the RealtyProfit platform for your legitimate business purposes. Under this license you may not:

• Modify or copy the platform's proprietary materials
• Use the platform for any unlawful purpose
• Attempt to decompile, reverse engineer, or disassemble any software contained on the Platform
• Remove any copyright or other proprietary notations from the materials
• Transfer your account to another person without authorization
• Share your login credentials with unauthorized users
• Violate any applicable laws or regulations

4. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Safeguarding your password and account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your email address and contact information remain current
• Maintaining the accuracy of financial data you input

5. Data Accuracy

You are responsible for the accuracy of data you input into RealtyProfit. We provide tools for tracking and analysis, but you should verify all financial information with your accountant or tax professional. RealtyProfit is not a substitute for professional financial or tax advice.

6. AI-Generated Content

RealtyProfit uses artificial intelligence (Anthropic's Claude) to generate categorization suggestions, insights, and recommendations. Users acknowledge that:

• AI-generated content should be reviewed before making business decisions
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated suggestions
• AI recommendations are general in nature and may not address your specific situation
• Users are responsible for validating all AI-generated content

7. Bank Account Connections

When you connect bank accounts or credit cards via Plaid:

• You authorize RealtyProfit to access transaction data through Plaid
• Your bank credentials are handled directly by Plaid and never stored by RealtyProfit
• You can disconnect accounts at any time
• You are responsible for ensuring you have authority to connect any accounts

8. Payment Terms

• Subscriptions are billed monthly or annually in advance
• Pricing is available at realtyprofit.app/pricing
• You can cancel anytime - no long-term contracts
• No refunds for partial periods of service
• We may change pricing with 30 days notice
• Failed payments may result in service suspension

9. Intellectual Property

The RealtyProfit platform, including its design, features, and original content, is protected by copyright, trademark, and other intellectual property laws. Your data remains your property, but you grant us a license to process and display it as necessary to provide our services.

10. Termination

You may cancel your account at any time through your account settings or by contacting support. We may suspend or terminate your account if you violate these terms. Upon termination:

• Your access to the platform will cease immediately
• You may export your data before cancellation
• We will retain your data for 30 days in case you change your mind
• After 30 days, your data will be permanently deleted

11. Disclaimer of Warranties

RealtyProfit is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, expressed or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

In no event shall RealtyProfit or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising from your use of the platform. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless RealtyProfit and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform or violation of these terms.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Dispute Resolution

Any disputes arising from these terms or your use of RealtyProfit shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Notice may be provided by:

• Email notification to the address on your account
• Prominent notice within the platform
• Updating the "Last Updated" date on this page

Your continued use of RealtyProfit after changes take effect constitutes acceptance of the updated terms.
